TERMS AND CONDITIONS (GTC)
1. Scope
These General Terms and Conditions (GTC) of Geraldine Khakshouri Consulting /muse-BEAUTY.ch, Alte Zürichstrasse 6, CH-8118 Pfaffhausen (hereinafter referred to as the provider ) regulate the rights and obligations in connection with the use of the muse-BEAUTY.ch website and the online one -Shops on this site. The terms and conditions apply to sales contracts with private customers and companies that are concluded via the muse-BEAUTY.ch website, as well as for sales contracts that are concluded in another way, e.g. by telephone, email or letter. Before concluding a contract, customers are asked to confirm the terms and conditions and have the option of downloading them.
These terms and conditions apply exclusively. Conditions that contradict, supplement or deviate from these terms and conditions require the express written confirmation of the provider in order to be valid.
The terms and conditions, the delivery and payment conditions as well as the data protection provisions may be adjusted from time to time.
2. Conclusion of a contract
The order is placed via the muse-BEAUTY.ch online shop and is confirmed by the provider by email. With this confirmation of the order, a contract is concluded between the customer and the provider. Orders placed are binding for the customer. This also applies to prepayment orders. The purchase contract is only concluded when the customer has paid the full purchase price.
The provider is free to reject orders and refuse to confirm them.
If an ordered product cannot be delivered despite a confirmation, the customer will usually be informed within five working days. The provider is entitled to withdraw from the entire contract or from part of the contract. The payment made will be refunded to the customer – without interest – and there will be no subsequent delivery of the products. Claims for non-delivery or late delivery are excluded. The delivered products remain the property of the provider until they have been paid for in full.
3. Information on muse-BEAUTY.ch
Muse-BEAUTY.ch presents information about and images of products. The provider points out that price and range changes as well as technical changes are reserved. All information such as product descriptions, images, films, dimensions and other information are to be regarded as approximate values and do not represent any assurance of properties or guarantees. The provider endeavors to provide correct and complete details and information, but can neither expressly nor tacitly guarantee this.
The provider cannot guarantee product availability at the time of ordering. All information on availability and delivery times is provided without guarantee and can change at any time and without notice.
4. Prices
All prices are gross in Swiss francs (CHF).
Any fees associated with the purchase (e.g. advance recycling fee) and processing costs are included. Shipping costs are charged separately depending on the order value and the place of delivery.
We reserve the right to make technical changes, errors and misprints. The provider reserves the right to change the prices at any time. The prices published on the website on the order date apply to customers.

5. Delivery
Delivery usually takes place within 2-4 working days. If a longer delivery period is necessary or if an article is no longer available despite a confirmed order, the customer will be informed of the facts after this time has elapsed at the latest. The payment made will be refunded or made available as a voucher.
As a rule, an order is sent as a whole, but the provider reserves the right to make partial deliveries in individual cases. In the case of partial deliveries, the provider bears the additional shipping costs.
Product descriptions may differ slightly from the products on muse-BEAUTY.ch . Such errors are reserved due to product range updates by the manufacturer. An exchange or claims for damages due to incorrect images, texts and prices or late delivery are excluded.
6. Shipping
muse-BEAUTY.ch primarily delivers in Switzerland and the Principality of Liechtenstein. Up to an order value of CHF 150, the customer bears the shipping costs of CHF 8.50. In addition, shipping is free of charge to the above two countries. For exceptional deliveries to other countries, special shipping costs apply. Vouchers are sent free of charge. The delivery time is usually 2 – 4 days.
The goods will be sent by post to the address specified by the customer in the order. With the dispatch, the benefit and risk are transferred to the customer. The provider is not liable for any damage that occurs during shipping and / or due to late arrival of the goods at the customer or a third party.
If the delivery cannot be delivered or if the customer refuses to accept the delivery, the provider can terminate the contract after notifying the customer of the complaint and setting a reasonable deadline, as well as charging the costs for the activities.
The customer is obliged to check the delivered goods immediately upon receipt of the delivery and to notify the provider immediately in writing of any defects for which the provider guarantees.
Returns to the provider are made exclusively for the account and at the risk of the customer. The customer must send the goods to the supplier in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects.
If the supplier’s inspection reveals that the goods do not have any noticeable defects or that these are not covered by the manufacturer’s guarantee, the supplier can invoice the customer for the activities, return or possible disposal.
7. Right of withdrawal
The customer is granted a right of withdrawal for 14 days after receipt of the goods. The revocation does not require any justification. The exercise of the right of withdrawal leads to a reversal of the contract. The customer must return the goods in their original packaging, unopened and complete with all accessories and together with the delivery bill. Returns to muse-BEAUTY.ch shall be made exclusively on account and at the risk of the customer. Any payment already made (with the exception of delivery costs as well as additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us) will be refunded to the customer within 14 days, provided that the supplier has already received the goods back or the customer provides proof that he has returned the goods.
The provider reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling or improper return and to deduct the reduction in value from the purchase price already paid or to invoice the customer. Similarly, the provider may refuse to refund if the customer has not returned the goods within the withdrawal period. The date of return is decisive in this respect.
The same means of payment that the customer used for the original transaction will be used for the refund, unless something else has been expressly agreed with the customer. Reimbursement will be made without deduction of expenses.

8. Warranty
For hygienic reasons, the exchange and return of opened, opened or used products is not possible. If you have any questions about an item, please contact us before buying, we will advise you gladly. muse-BEAUTY.ch endeavors to deliver goods in perfect quality. If the delivered goods deviate from the order or show defects, the provider must be informed by email within 3 working days, after 3 days the goods are deemed accepted without complaint. The customer must then return the goods within 1 week. It is at the discretion of the provider to provide the warranty with an equivalent replacement or a refund of the purchase price. Further claims are excluded.
The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or by the post office during shipping, as well as defects that can be traced back to external circumstances.
It is not possible for the provider to give assurances or guarantees for the topicality, completeness and correctness of the data as well as for the constant or undisturbed availability of muse-BEAUTY.ch , its functionalities, integrated hyperlinks and other content. In particular, it is neither assured nor guaranteed that the use of muse-BEAUTY.ch will not violate any rights of third parties that are not in the possession of the provider.
9. Liability
Geraldine Khakshouri Consulting / muse-BEAUTY.ch assumes no liability for the handling, ingestion, application and use of the items supplied.
The customer is responsible that he / she discusses known incompatibilities or possible incompatibilities or effects with a specialist or gets advice before using the articles. Dosage or application recommendations given on the articles must be taken into account. Should there nevertheless be side effects or health restrictions, the provider assumes no liability.
The provider also excludes any liability, regardless of its legal basis, as well as claims for damages against the provider and any auxiliary persons and vicarious agents. In particular, the provider is not liable for indirect damage and consequential damage caused by defects, lost profit or other personal, property or pure financial damage suffered by the customer or by third parties. Further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.
The provider only uses hyperlinks on muse-BEAUTY.ch to facilitate customer access to other websites. The provider can neither know the content of this website in detail, nor assume liability or other responsibility for the content of these websites.
The provider undertakes to ensure security in accordance with the latest technical standards in systems, programs, etc. that belong to him and over which he has influence, and to follow the rules of data protection.
Customers have to ensure the security of the systems, programs, data and passwords that are within their sphere of influence.
The provider is not liable for defects and malfunctions for which he is not responsible, especially not for security defects and operational failures of third-party companies.
Furthermore, the provider is not liable for force majeure, improper procedures and disregard of the risks on the part of the customer or third parties, excessive use, unsuitable operating resources of the customer or third parties, unforeseeable environmental influences, interventions by the customer or disruptions by third parties (viruses, etc.), which despite the current safety precautions happen.
10. Payment
The payment options specified in the ordering process are available to the customer.
The provider reserves the right to exclude customers from individual payment options without giving reasons and / or to request prepayment.
If the customer defaults on payment, the provider can charge default interest of 5% per year and a reminder fee of a maximum of CHF 20 per reminder.
The delivered goods remain the property of Geraldine Khakshouri Consulting / muse-BEAUTY.ch until they have been paid for in full.
11. Data protection
The provider’s data protection provisions apply, which can be viewed and downloaded from their website. They are an integral part of these terms and conditions.
The provider may process and use the data collected in the context of the conclusion of the contract to fulfill the obligations from the purchase contract and use it for marketing purposes. The data required to fulfill the service can also be passed on to commissioned service partners (logistics partners) or other third parties.
12. Application of law and place of jurisdiction
Swiss law applies to these terms and conditions, namely the provisions of the OR.
The court at the place of residence or domicile of one of the parties is responsible for complaints by a customer. The court at the place of residence of the defendant is responsible for actions brought by the provider. The place of jurisdiction for business customers or legal persons is exclusively the seat of the provider.
The masculine form always includes the feminine.
13. Severability Clause
If a provision of these terms and conditions or a sales contract is declared void or legally ineffective, the remaining provisions remain unaffected and are to be interpreted as if the provision or agreement had been concluded without the invalid provision. The same applies to any gaps in the regulation.
